The glass negatives of Carl lying in the funeral parlour in Naples are held by a descendant in Toowoomba. They had to be forwarded to our authorities as proof of death.
- On 13 October 1914 The Brisbane Courier reported:-
" A will, executed under somewhat unusual circumstance, came under the notice of his Honour Mr. Justice Chubb, in Chambers, yesterday. A farmer named Carl Priebe, who resided at Bergen, near Toowoomba, while on a trip to Europe, was taken ill at Naples, and entered the German Hospital there. He died in the institution in October, 1913. His will was drawn by the British Vice-Consul, and was witnessed by two of the nurses. After his death it was forwarded to his widow, who resides at Bergen. On being lodged at the Supreme Court Registry for probate purposes a question arose as to whether it had been properly attested, and the matter was referred to his Honour. The attestation clause did not state that the attesting witnesses had signed the will in the presence of the testator but its execution was attested by the Vice-Consul. Mr. Macleod (instructed by Measra. Feez, Ruthning, and Baynes) applied fo rprobate to he granted to Mrs. Catherine Priebe; notwithstanding the apparent defect in the attestation clause, resting his application on the attestation by the British Vice-Consul, and the impracticability of obtaining the evidence of the attesting witnesses. His Honour decided to take official notice of the signature and seal of the Vice-Consul, and holding that the will had apparently been executed according to law, ordered probate to issue to the widow, "subject to
the filing of an affidavit by the widow verifying the signature of the testator". He also gave leave for the will to be taken off the file for that purpose."
