It is surmised that the gears then jammed, and one wheel of the car left the crossing, and the vehicle toppled over into the creek in 4ft. of water. Most of the occupants got clear of the car, but Mrs. Gavin, sen., was drowned. Her husband was in the last stages of exhaustion when rescued, but he revived under treatment, although he suffered from shock, as did all the other members of the party.

His parents finallly gave their consent and he served in the Light Horse in Moascar. He gave his next of kin as his mother Mary of Pechey. At the time he enlisted he was a shop assistant working for F. J. Poulgrain of Pechey. He was discharged on 30 Oct 1919.
  
• James Gavin was listed as the next of kin of Patrick Joseph Gavin when she enlisted in the Australian Army on 17 February 1917 in Toowoomba. His service number ws 3261 and he gave his next of kin as his father James. At the time he was a Locomotive Cleaner and stated his age as 19 years, 4 months. He served with the 26/5 Light Horse in Moascar and was discharged on 25 Sep 1919.
  
• In March 1917 James and Mary retired. The Brisbane Courier noted on 25 March :" Mr James Gavin, lengthsman, was presented with a suit case by his fellow employees last Tuesday, on the occasion of his retirement from the railway service. Mr Gavin has been with the department for 28 years. It is noteworthy that he has seven sons wearing the King's uniform-five as soldiers and two as mounted police."
  The on 10 April :- " Mrs James Gavin was entertained by the residents of Pechey and surrounding districts at a social in the Pechey State School, on the occasion of her retirement after 25 years public service (writes our Crow's Nest correspondent).
  Mr Gavin had previously been presented with an inscribed suit case by his fellow employees, he having retired after 28 years service with the Railway Department. An enjoyable programme was rendered, and during the evening the chairman, Mr E Pechey. presented Mrs Gavin with a tea and coffee service on a tray and a silver cake basket. Mr Gavin responded on behalf of his wife."
• On 3 August 1930,his wife, Mary Elizabeth Drift died in Queensland. Mary death was reported in The Brisbane Courier on 4 August 1930
  "COOKTOWN, August 4.
  When a motor car containing eight persons toppled over into Saltwater Creek, about eight miles from Cooktown, yesterday morning, Mrs. James Gavin, sen., of Toowoomba, was drowned. Her husband was in the last stages of exhaustion when rescued.
  A motor car party, comprising Acting-Sergeant Gavin and his wife and three children, Mr. and Mrs. Gavin, sen., and the driver, Mr. C. Ure, left the town on Sunday morning, intending to spend the day with friends on the Endeavour River. When approaching the Saltwater Creek, eight miles from Cooktown, the car refused to negotiate an incline. The driver, Mr. C. Ure, backed the car, and then went forward again. It is surmised that the gears then jammed, and one wheel of the car left the crossing, and the vehicle toppled over into the creek in 4ft. of water. Most of the occupants got clear of the car, but Mrs. Gavin, sen., was drowned. Her husband was in the last stages of exhaustion when rescued, but he revived under treatment, although he suffered from shock, as did all the other members of the party.

  The late Mrs. Gavin, with her husband, had been on a holiday visit to their son, Police-Sergeant Gavin, of the Cooktown station, and had intended to return to their home this week. The deceased was a native of this State, and for over 30 years was a gatekeeper on the Crow's Nest line. She is survived by six sons and two daughters. Five of the sons saw service in the late war, one being killed in action. The daughters are Mesdames L. Chaffey (Bowen Hills, Brisbane), and S. Coman (North Ipswich), and the sons Mr. John Gavin (engineer attached to the Willowburn Mental Hospital), Constable William Gavin (Mourilyan Police Station), and Messrs. George Gavin (Barcaldine), Joseph Gavin (Railway Department, Chillagoe), Steven Gavin (Mourilyan), and Sergeant D. Gavin (Cooktown)."
• James Gavin died on 24 February 1945 in Queensland.

James Augustus Gavin

• James Augustus Gavin was born in December 1885 in Jondaryan, Queensland.
• He was the son of James Gavin and Mary Elizabeth Drift.
• James Augustus Gavin and Michael Travers selected land in April 1902 in Crow's Nest. Michael selected 80 acres and James, his cousin 100 acres.
  
• James Augustus Gavin began military service on 9 February 1915 in Enoggera, Brisbane. He was a 29 year, 3 months old station hand and gave his next of kin as his father James Gavin of Pechey (later of Argyle Street, Toowoomba). He enlisted in the 31st Battalion service number 482. He was promoted to Lance Corporal on 29 Apr 1916.
• James Augustus Gavin was killed in action on 19 July 1916 in France at age 30.
• James was buried in Eaton Hill Cemetery, Armentiers.
